By downloading, browsing, accessing, or using any of the applications within the ToT Master suite ("Apps"), including Tot Org, Tot Teacher, Tot Driver, and TotMaster, you agree to be bound by these Terms and Conditions of Use. ToTMaster LLC ("ToTMaster LLC," "we," "us") reserves the right to amend these terms and conditions at any time. If you disagree with any of these Terms and Conditions of Use, you must immediately discontinue your access to the Apps and your use of the services offered within the Apps. Continued use of the Apps will constitute acceptance of these Terms and Conditions of Use, as may be amended from time to time.

USER VERIFICATION

OTP Verification and User Consent: As part of our user verification process, we may send a One-Time Password (OTP) to your phone number and email address. In the United States, it is required by law that we obtain your consent before sending any OTPs. By providing your phone number and email address and requesting to receive an OTP, you consent to receive these messages from ToTMaster LLC for verification purposes. If you do not consent to receive OTPs, you must immediately discontinue your use of the verification services within the Apps.

TERMS TO USE

Changes to the Apps: ToTMaster LLC reserves the right to make changes to the Apps or to charge for its services, at any time and for any reason. We will never charge you for the Apps or their services without making it clear to you exactly what you’re paying for.

Personal Data Handling: The Apps store and process personal data that you provide to us in order to provide ToTMaster LLC Service. It is your responsibility to keep your device and access to the Apps secure. We recommend that you do not jailbreak or root your phone, as it may compromise your phone’s security features and the functionality of the Apps.

Responsibility for Usage: ToTMaster LLC cannot always take responsibility for the way you use the Apps. You are responsible for ensuring that your device stays charged, as failure to do so may disrupt your access to the services offered by the Apps.

App Updates: We may wish to update the Apps, and it is your responsibility to download these updates to ensure continued functionality. ToTMaster LLC does not promise to update the Apps to be compatible with all device versions, but you agree to accept updates when offered.

App Source: We strongly recommend that you only download the ToT Master applications from the official Play Store or App Store to ensure legitimacy and safety.

GENERAL TERMS

License Grant; Compliance with Terms of Use: The Application is licensed, not sold, and ToTMaster LLC reserves all rights not expressly granted in this Agreement. Subject to the terms and conditions hereof, ToTMaster LLC grants you a personal, nonexclusive, non-transferable, non-sublicensable, limited license to download and use the Application on a mobile device that you own or control.

License Restrictions: Except as specifically provided herein, You may not: (i) distribute or make the Application available over a network where it could be used by multiple devices at the same time; (ii) copy the Application; (iii) modify, adapt, translate, reverse engineer, make alterations, decompile, disassemble or make derivative works based on the Application, except as otherwise permitted by law; or (iv) use, rent, loan, sublicense, lease, distribute or attempt to grant other rights to the Application to third parties.

Your Warranty to ToTMaster LLC: You represent and warrant that: (i) You have the authority to bind Yourself to this Agreement; (ii) Your use of the Application will be solely for purposes that are permitted by this Agreement; and (iii) Your use of the Application will comply with all local and national laws, rules, and regulations (“Laws”).

Privacy: By using the Application, you agree that ToTMaster LLC may collect and use certain information about you, your mobile device, your use of the Application and the Application’s performance in accordance with the Privacy Policy, as may be amended from time to time.

Indemnity: You agree to indemnify and hold harmless ToTMaster LLC and its affiliates, officers, directors, employees, consultants, agents and anyone providing information or software used in the Application from any and all claims arising from, related to, or incidental to Your use of the Application.

Termination: This Agreement is effective until terminated. ToTMaster LLC may immediately terminate this Agreement at any time at its sole discretion with or without notice to you. Upon termination, all legal rights and licenses granted to You hereunder shall terminate immediately and You shall cease all use of the Application and destroy all copies of the Application.

Acknowledgment of Understanding/Entire Agreement: You acknowledge that You have read this Agreement, understand it and agree to be bound by its terms and conditions. You also agree that this Agreement is the complete and exclusive statement of the Agreement between ToTMaster LLC and You and supersedes all proposals, representations or prior agreements, oral or written, and any other communications between ToTMaster LLC and You relating to the subject matter of this Agreement.

Severability: You agree that the terms and conditions stated in this Agreement are severable. If any paragraph, provision, or clause in this Agreement shall be found or be held to be invalid or unenforceable in any jurisdiction, the remainder of this agreement shall be valid and enforceable.

Assignment and Transfer: ToTMaster LLC may assign, transfer, sell, rent or lend this Agreement, in whole or in part, at any time without notice to You. You may not assign this Agreement or any part of it or any rights to use the Application, in whole or in part, either temporarily or permanently, to any other party. Any attempt to do so is void.

DATA DELETION AND RETENTION

We are committed to ensuring the privacy and security of your personal data. As part of our data protection measures, we have implemented the following policies:

Data Deletion: Upon your request or upon termination of your account, we will promptly delete or anonymize your personal data from our systems, except where retention is required by law or for legitimate business purposes.

We shall not be liable for any acts or omissions of any third parties howsoever caused. We disclaim any liability for direct, indirect, incidental, special, consequential, or punitive damages resulting from or in connection with your access to, use of, or inability to use the ToT Master Applications or their services.

INTELLECTUAL PROPERTY RIGHTS

Ownership and Protection: All editorial content, information, photographs, illustrations, artwork, and other graphic materials, as well as names, logos, and trademarks on the ToT Master Applications, are protected by copyright laws and/or other applicable laws and/or international treaties. These intellectual properties belong to us and/or our suppliers, as applicable.

Restrictions on Usage: The aforementioned works, logos, graphics, sounds, or images may not be copied, reproduced, retransmitted, distributed, disseminated, sold, published, broadcasted, or circulated, whether in whole or in part, unless expressly permitted by us and/or our suppliers.

Trademark Usage: Nothing contained on the ToT Master Applications should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark displayed without our written permission. Misuse of any trademarks or any other content displayed is strictly prohibited.

Legal Action: We reserve the right to take legal action against any unauthorized usage of our trademarks, names, or symbols to preserve and protect our rights in the matter. All rights not expressly granted herein are reserved. Mention of other product and company names may be trademarks of their respective owners.

COPYRIGHT INFRINGEMENTS

We highly value and respect the intellectual property rights of others. If you believe that any material available on or through the ToT Master Applications infringes upon any copyright you own or control, we urge you to immediately notify us using the contact information provided below.
